1. Overview

These Terms of Service ("Terms") govern your use of MarkAI, an AI-powered sales communication assistant operated by markhelp.me ("MarkAI", "we", "us", "our"). By using MarkAI you agree to these Terms. If you do not agree, do not use the service.

2. The Service

MarkAI provides an AI-powered inbox that unifies Gmail, Telegram, and WhatsApp, and uses artificial intelligence to help sales professionals draft replies, detect buying signals, track deals, and close faster.

3. Eligibility

You must be at least 16 years old to use MarkAI. By using the service you confirm you meet this requirement and have the legal capacity to agree to these Terms.

4. Your Account

You are responsible for maintaining the security of your account and password. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

5. Acceptable Use

You agree to use MarkAI lawfully and responsibly. You may not use MarkAI to:

• Violate any applicable law or regulation
• Harm, harass, or deceive others
• Send spam, phishing, or abusive content
• Impersonate any person or entity
• Attempt to exploit, hack, or disrupt the service
• Scrape, reverse engineer, or copy the platform
• Violate the rights of any third party

6. Gmail and Third-Party Integrations

When you connect Gmail or other third-party services, you authorize MarkAI to access those services on your behalf as described in our Privacy Policy. You are responsible for ensuring you have the right to connect those accounts. You may disconnect integrations at any time from your account settings.

7. AI-Generated Content

MarkAI uses artificial intelligence to generate reply suggestions, deal insights, and follow-up recommendations. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• You are solely responsible for reviewing all AI-generated content before sending
• MarkAI is not responsible for the outcome of any communication sent using the service
• AI suggestions do not constitute legal, financial, or professional advice

8. Subscription and Payment

MarkAI offers a free plan and paid Pro plan. Paid plans are billed through Stripe. By subscribing you agree to pay all applicable fees. Subscriptions auto-renew unless cancelled. You may cancel at any time from your account settings. Refunds are not provided for partial billing periods unless required by law.

9. Intellectual Property

MarkAI and all associated technology, design, and content are owned by markhelp.me. You may not copy, modify, distribute, or create derivative works without our written permission. You retain ownership of your own data and content.

10. Data and Privacy

Your use of MarkAI is also governed by our Privacy Policy at https://markhelp.me/privacy. By using MarkAI you agree to the collection and use of your data as described there.

11. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue the service at any time with reasonable notice where possible.

12. Limitation of Liability

To the maximum extent permitted by law, MarkAI is provided "as is" without warranties of any kind. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of data or business losses
• Outcomes of AI-generated content
• Third-party service failures (Gmail, OpenAI, Stripe, etc.)

Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim.

13. Indemnification

You agree to indemnify and hold harmless markhelp.me, its founders, and employees from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the European Union and applicable national laws. Any disputes shall be resolved in the courts of the jurisdiction where markhelp.me operates.

15. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using MarkAI and delete your account at any time from account settings. Upon termination, your data will be deleted as described in the Privacy Policy.

16. Changes to Terms

We may update these Terms. We will notify you of significant changes by email or in-app notice. Continued use of MarkAI after changes means you accept the updated Terms. The "Last updated" date reflects the most recent version.
